By using this website and Resparke application and Resparke Lifestory feature (the application) you agree to be bound by the terms and conditions set out on this webpage. If you do not accept these terms and conditions, you must refrain from using the application. This application is owned and operated by Resparke Technology Pty Ltd (ACN 623 653 261) trading as Resparke (referred to in these terms and conditions as ‘we’, ‘us’, or ‘our’).
Intellectual property
Unless otherwise indicated, all materials used on the application (including text, graphics, logos, icons, sound recordings and software) are subject to copyright, trade mark or other intellectual property rights that are owned or licensed by us. You may only access and use these materials for non-commercial or personal use, except to the extent permitted by law or where you have received prior written approval from us.
Liability
We make no warranties or representations about this application or any of its content and will not be responsible to you or any third party for any direct or consequential loss suffered in connection with the use of this website. To the maximum extent permitted by law, we exclude any liability that may arise due to your use of our website and/or the information or materials contained on it.
Use of the application
Eligibility
You must be at least 18 years old to use our application. By using our application, you represent and warrant that you are of legal age to form a binding contract.
User Accounts
To access certain features of the application, you may be required to provide your name and email address. You are responsible for maintaining the confidentiality of your account credentials and agree not to share them with others.
Uploading and Sharing Content and Information
You own all of the content and information you upload on Resparke. In addition:
For all content that you upload and share (IP Content), you specifically give us the following permission: you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any content that you upload on or in connection with Resparke Lifestory for yourself or a next of kin (NOK). You acknowledge that the purpose of uploading this IP Content is to enable staff to better know for and care for you or your NOK in a Care homes with has Resparke (care home). You acknowledge that others in the care home are able to login in and access your IP Content for this purpose.
This IP License ends when you or the care home delete your IP content. When you delete IP content, it is deleted in a manner similar to emptying the recycle bin on a computer.
In relation to the content you upload:
- You will not upload viruses or other malicious code.
- You will not upload any content that: is hate speech, threatening, or pornographic; incites violence; or contains nudity or graphic or gratuitous violence.
- You will not upload content which is false or misleading or untrue.
- You understand and accept you take full responsibility for the content you upload.
We reserve the right to remove any content at any time which in our view contravenes these guidelines.
Privacy
These terms and conditions also include our Privacy Policy that can be accessed by clicking the link on this page.
Termination
We reserve the right to terminate or suspend your access to the application, with or without notice, for any violation of these ToS or for any reason we deem necessary to protect our interests.

Our application may contain links to websites operated by third parties. Those links are provided for convenience and may not remain current or be maintained. Unless expressly stated otherwise, we do not endorse and are not responsible for the content on those linked websites and have no control over or rights in those linked websites.
Updates
We may change these terms and conditions at any time by updating this webpage and your continued use of the website following such update will represent an agreement by you to be bound by the terms and conditions as amended.
Jurisdiction
Your use of the application and these terms and conditions are governed by the laws of New South Wales, Australia.
